Officially, be honest to the officer, regardless of what he asks.
Friend to friend, keep your mouth shut. It's damn near impossible to prove a weed DUI in court. It's possible, but probably unlikely unless you get a hanging judge.
Officer: Why does it smell like weed in your car?
You: "My asshole buddy apparently had some on him earlier so I kicked him out of my car when I smelled it."
However, if you have a small amount in the vehicle (ie a roach or shake), be honest before he finds it and pray for the best.
In Alabama, your 1st POM conviction, provided that it's "personal use" quantities, is a Class A misdemeanor. DO NOT HAVE ADDITIONAL BAGGIES ON YOU, EVER!!! After that, regardless of quantity, intent or packaging, it's a felony.
I'm constantly amazed by how many people who smoke it in their car. Most probably don't drink and drive, or rarely ever push that envelope, but a shitload of people seem to think it's a great idea to fire one up while driving.
I can usually smell it driving down the road behind these cars...especially that nasty loud shit. It's damn near Darwinian imho.

Saw a guy in Walmart walking with his upper torso tilted at almost 45° the other day. He wreaked like a hippie Indian blanket and I couldn't believe that he was able to walk around like that. Freaking hilarious. My wife shot me a dirty look and told me to leave him alone. I just wanted to freak him out but she wasn't having it.
